This Site is operated by BikeSportz Imports Pty Ltd (ABN 75 004 710 150), trading as BikeSportz. BikeSportz supplies cycling parts, accessories, apparel and nutrition to Australian bike dealers and the wider cycling industry. Questions? Definitions

  • Account means an approved trade account that gives you access to account pricing and ordering on the Site.
  • Delivery Address means the address stated on your order.
  • Delivery Agent means a third party delivery or shipping company engaged by us to deliver your order.
  • GST has the meaning given in A New Tax System (Goods and Services Tax) Act 1999 (Cth).
  • Law means any statute, regulation, order, rule, ordinance or by-law, and any custom or policy recognised and enforced by judicial decision.
  • Personal Information has the meaning given in the Privacy Act 1988 (Cth).
  • Privacy Policy means the BikeSportz Privacy Policy.
  • RRP means the recommended retail price shown to visitors who are not signed in to an Account.
  • Site means bikesportz.com.au.
  • We, Us, Our means BikeSportz Imports Pty Ltd (ABN 75 004 710 150), trading as BikeSportz.
  • You and Your means the person using the Site or placing an order through an Account.

Terms of Use

These terms and conditions (Terms) govern your use of the BikeSportz Site and orders placed through it. By using the Site you agree to these Terms and to our Privacy Policy, and you warrant that all information you provide to us is accurate.

We may amend these Terms or any page of the Site at any time. Please check the current Terms each time you use the Site.

Trade Accounts and Pricing

  1. The Site is for the cycling industry. Account pricing and ordering are available only to approved Account holders. To apply, see Become a Dealer.
  2. Visitors who are not signed in to an Account see RRP only and cannot purchase products.
  3. We may approve, decline, suspend or close an Account at any time.
  4. You are responsible for keeping your Account details confidential and for all activity under your Account. Please tell us promptly if you believe your Account has been accessed without permission.

Orders

  1. You may place an order through your Account by following the instructions on the Site. By placing an order, you are offering to purchase the products in that order. Your order is received when we send an order confirmation to your nominated email address. You are responsible for providing a correct email address and contact details.
  2. Each order is a separate contract between you and BikeSportz Imports Pty Ltd.
  3. A tax invoice will be issued when your products are ready for despatch.
  4. We may restrict the quantity of a product that can be ordered. Any restriction will be stated on the Site or otherwise advised.
  5. We are not liable for any loss caused by a delay or failure to process your order or deliver your products because of inaccurate or incomplete details in your order.
  6. Separate orders cannot be consolidated. A separate delivery fee, if applicable, applies to each order.
  7. If we cannot contact you about your order after reasonable attempts, your order may be cancelled and any money paid refunded.
  8. Products may be out of stock or unavailable. If we cannot fulfil all or part of your order, we will refund or credit you for the affected products.
  9. We may withdraw or suspend any product from sale at any time.
  10. We take reasonable care to ensure details, descriptions, images and prices on the Site are accurate, but errors may occur. If we find an error we will contact you and give you the option to reconfirm your order at the correct price or cancel it. If we cannot reach you, we will treat the order as cancelled and refund you in full. We may decline to fulfil orders based on errors or inaccuracies, including in pricing, descriptions, images or policies.
  11. We may offer promotional discount or coupon codes. Codes must be applied before you submit your order, and other conditions will be stated at the time of issue.
  12. Product dimensions and measurements are approximate and may vary slightly. Accessories shown with a product are for illustration and may be sold separately.
  13. All prices are in Australian dollars. Whether GST is included or excluded is shown on the Site and on your tax invoice.
  14. We may change prices without notice. If you have already submitted an order, we will supply it at the price you were shown, unless it is affected by a pricing error.
  15. Payment methods and payment terms are shown on the Site or agreed with your Account. The name on any card or payment account used must match the name on the order.
  16. In paying for products, you agree you have not engaged in fraudulent conduct or contravened any Law.
  17. We may accept or reject any order at any time. If we reject your order, you will receive a refund of any money paid.

Delivery

  1. Delivery fees and estimated delivery times are shown at checkout or in your order confirmation. Delivery times are estimates and may be affected by postal delays or events outside our control, for which we are not responsible.
  2. Your order may be fulfilled from multiple locations at different times. If your order is split, you will not be charged additional delivery fees.
  3. A signature on delivery may be required. If you refuse to sign, this will be taken as refusal to accept delivery. If re-delivery is needed, you must pay the additional delivery fees, and delivery fees already paid will not be refunded unless required by Law.
  4. If no one is at the Delivery Address, the Delivery Agent will leave a collection card with instructions.
  5. Products will be delivered to the address on the order. Where the address is an office, shared premises or apartment, you agree we may deliver to an individual at that address and rely on their instructions as if they were yours.

Returns, Warranty and Credits

  1. Returns, credits and warranty claims on trade orders are handled through our customer service team. Please Contact Us before sending anything back. For warranty claims, see our Warranty and Support Centre.
  2. We may provide a warranty in addition to your rights under the Australian Consumer Law. Warranty terms vary by product and brand and are set out in the product packaging, brochures or our Warranty and Support Centre.
  3. Nothing in these Terms limits your rights under the Australian Consumer Law.

General

  1. If your payment triggers our fraud prevention checks, we may contact you for more details or reverse the transaction. If you do not respond in the required time, your order will be cancelled and any payment returned to the original payment method.
  2. Links to other websites are not maintained or controlled by us. We make no warranties about them and accept no liability for their content or use. You use them at your own risk.
  3. We will use reasonable endeavours to keep the Site available, but do not warrant that it will be continuous, uninterrupted, secure or virus-free.
  4. To the extent permitted by Australian Law, we are not liable for any compensatory or exemplary damages arising from use of, or inability to use, the Site, even if we have been advised of the possibility of damages.
  5. Our failure or delay in acting on a breach of these Terms is not a waiver of those Terms or our rights.
  6. We may terminate the agreement for the supply of products to you for convenience on reasonable notice, or if we reasonably believe you have breached these Terms or committed fraud and the breach cannot be remedied or is not remedied in the time provided.
  7. These Terms are governed by the laws of Victoria, Australia, and you submit to the exclusive jurisdiction of the courts of Victoria.
  8. By agreeing to these Terms you also agree to receive marketing communications about our products, services, promotions and offers. You can opt out at any time using the unsubscribe link in our emails. See our Privacy Policy for how we use your personal information.
